These Patient Terms of Service ("Terms") govern your access to and use of CashPayClinics.com and related CashPayClinics websites, applications, features, and services (collectively, the "Platform").
Throughout these Terms, "CashPayClinics," "Company," "we," "us," or "our" refers to CashPayClinics and the entity operating the CashPayClinics Platform.
"You," "your," "patient," or "user" refers to any individual accessing or using CashPayClinics to search for healthcare services, communicate with participating providers, request appointments, make payments where available, or otherwise use the Platform.
By creating an account, checking an acceptance box, submitting an appointment request, making a payment through the Platform, or otherwise using CashPayClinics, you acknowledge that you have read, understand, and agree to these Terms.
If you do not agree to these Terms, do not use CashPayClinics.
1. ABOUT CASHPAYCLINICS
CashPayClinics is an online healthcare marketplace designed to help patients find independent healthcare professionals, practices, clinics, facilities, laboratories, imaging centers, and other participating healthcare businesses offering direct-pay or self-pay healthcare services.
CashPayClinics may allow patients to:
- Search for healthcare providers and facilities;
- Search by specialty, service, procedure, location, price, or other criteria;
- View participating Provider profiles;
- Review self-pay prices;
- Compare Providers and services;
- Request appointments;
- Receive appointment notifications;
- Make payments where payment functionality is available;
- Communicate information related to appointment requests; and
- Access other healthcare marketplace features.
CashPayClinics is a technology marketplace and is not itself a healthcare provider.
2. CASHPAYCLINICS DOES NOT PROVIDE MEDICAL CARE
CashPayClinics does not:
- Practice medicine;
- Diagnose medical conditions;
- Provide medical advice;
- Prescribe medications;
- Recommend specific treatments;
- Determine whether a treatment is medically necessary;
- Establish treatment plans;
- Supervise healthcare Providers;
- Control a Provider's professional judgment; or
- Guarantee medical outcomes.
Healthcare services obtained through a Provider found on CashPayClinics are provided solely by the independent Provider.
Any diagnosis, treatment, prescription, medical recommendation, procedure, test, or other healthcare service is the responsibility of the Provider providing that service.
3. INDEPENDENT HEALTHCARE PROVIDERS
Healthcare Providers listed on CashPayClinics operate independently from CashPayClinics unless specifically stated otherwise.
Providers are not employees, agents, or representatives of CashPayClinics merely because they are listed on the Platform.
Providers are independently responsible for:
- Their professional licenses and credentials;
- Their medical decisions;
- Their clinical judgment;
- Their treatment recommendations;
- Their facilities and staff;
- Their medical documentation;
- Their billing practices;
- Their compliance with applicable laws;
- Their professional liability;
- Their patient relationships; and
- The healthcare services they provide.
CashPayClinics does not direct or control the practice of medicine or other healthcare services provided by participating Providers.
4. NO PROVIDER-PATIENT RELATIONSHIP WITH CASHPAYCLINICS
Using CashPayClinics does not create a physician-patient, clinician-patient, therapist-patient, facility-patient, or other healthcare professional relationship between you and CashPayClinics.
A professional healthcare relationship may be established between you and a participating Provider according to applicable law and the Provider's practices.
CashPayClinics is not a party to the medical relationship between you and a Provider.
5. NOT FOR MEDICAL EMERGENCIES
CASHPAYCLINICS IS NOT AN EMERGENCY MEDICAL SERVICE.
Do not use CashPayClinics to obtain assistance for a medical emergency.
If you believe you may be experiencing a medical emergency, call 911 or go immediately to the nearest emergency department.
Examples of potentially serious emergencies may include severe chest pain, difficulty breathing, severe bleeding, loss of consciousness, signs of stroke, serious allergic reactions, severe injuries, or other conditions requiring immediate medical attention.
Do not delay emergency care while waiting for an appointment request or response through CashPayClinics.
6. ELIGIBILITY
You must be legally capable of agreeing to these Terms to independently create and use a CashPayClinics account.
Where permitted by the Platform, a parent, legal guardian, or other legally authorized representative may use CashPayClinics on behalf of a minor or another person for whom that individual is legally authorized to act.
By using CashPayClinics on behalf of another person, you represent that you have legal authority to do so.
CashPayClinics may restrict certain services based on age, location, legal requirements, Provider requirements, or other appropriate criteria.
7. PATIENT ACCOUNT INFORMATION
When creating or using a CashPayClinics account, you agree to provide accurate, complete, and current information.
You are responsible for keeping your information updated, including your:
- Name;
- Email address;
- Mobile telephone number;
- Payment information when applicable; and
- Other account information.
You may not create an account using another person's identity without authorization.
8. ACCOUNT SECURITY
You are responsible for maintaining the confidentiality of your account credentials.
You agree to:
- Maintain a secure password;
- Protect one-time verification codes;
- Avoid sharing login credentials with unauthorized individuals;
- Notify CashPayClinics if you suspect unauthorized access; and
- Take reasonable precautions to protect your account.
CashPayClinics may use identity verification, email verification, SMS verification, one-time passwords, or other security measures.
9. PROVIDER INFORMATION AND CREDENTIALS
CashPayClinics may collect, display, or verify information provided by participating Providers, including professional credentials, licensing information, specialties, services, locations, and pricing.
However, professional credentials, licensing status, disciplinary status, availability, and other Provider information may change.
Patients remain free to independently verify a Provider's qualifications before obtaining healthcare services.
The presence of a Provider on CashPayClinics does not constitute a guarantee by CashPayClinics regarding the Provider's quality of care, suitability, competence, or medical outcomes.
10. SEARCH RESULTS AND PROVIDER RANKINGS
CashPayClinics may display Providers based on factors such as:
- Location;
- Distance;
- Specialty;
- Service;
- Price;
- Availability;
- Patient preferences;
- Platform participation;
- Search relevance;
- Ratings;
- Profile completeness; or
- Other marketplace criteria.
The order in which Providers appear should not be interpreted as a medical recommendation.
Patients remain responsible for deciding which Provider they wish to contact or request an appointment with.
11. SELF-PAY HEALTHCARE MARKETPLACE
CashPayClinics is designed primarily for patients seeking healthcare services using direct payment or self-pay arrangements.
Unless specifically stated otherwise, prices displayed on CashPayClinics are self-pay prices and should not be interpreted as insurance-negotiated rates.
CashPayClinics does not guarantee that:
- Your insurance will cover a listed service;
- Your insurer will reimburse you;
- A payment will count toward your deductible;
- A Provider will submit an insurance claim; or
- A healthcare service qualifies for reimbursement under any insurance plan.
Patients should contact their insurer directly regarding insurance coverage or reimbursement.
12. PRICES DISPLAYED ON CASHPAYCLINICS
CashPayClinics is designed to promote healthcare price transparency.
Prices displayed on Provider profiles are generally supplied, approved, or maintained by participating Providers.
Providers are responsible for keeping their prices accurate.
The displayed price may apply only to the specific service described.
Additional charges may arise if additional healthcare services become necessary, such as:
- Laboratory testing;
- Imaging;
- Medications;
- Procedures;
- Medical supplies;
- Additional consultations;
- Pathology;
- Anesthesia;
- Facility services; or
- Other healthcare services.
The Provider should disclose additional charges where appropriate.
Patients should ask the Provider about anticipated additional costs before agreeing to additional non-emergency services.
13. APPOINTMENT REQUESTS
Submitting an appointment request through CashPayClinics does not necessarily mean that the appointment has been confirmed.
The Provider may:
- Accept the request;
- Decline the request;
- Propose another time;
- Request additional information; or
- Be unable to accommodate the request.
An appointment should be considered confirmed only when confirmation is provided through the applicable CashPayClinics feature or directly by the Provider.
14. NO GUARANTEE OF APPOINTMENTS
CashPayClinics does not guarantee:
- Provider availability;
- Appointment acceptance;
- Appointment confirmation;
- Appointment times;
- Provider response time;
- Availability of a specific procedure;
- Availability of a specific price;
- That a Provider will determine a requested service is medically appropriate; or
- Any specific medical outcome.
A Provider may determine after evaluating you that a requested service is inappropriate or that additional care is necessary.
15. CANCELLATIONS AND RESCHEDULING
Providers may establish their own cancellation, rescheduling, late-arrival, or no-show policies.
Patients are responsible for reviewing and complying with Provider-specific policies that are disclosed to them.
CashPayClinics may also establish Platform-level cancellation or payment policies where applicable.
16. PAYMENTS
Where CashPayClinics provides payment functionality, payments may be processed by CashPayClinics or an independent third-party payment processor.
By submitting payment information, you represent that you are authorized to use the selected payment method.
You authorize the applicable payment processor to charge the disclosed amount to your selected payment method.
Additional payment terms may apply depending on the transaction.
17. THIRD-PARTY PAYMENT PROCESSORS
CashPayClinics may use independent payment processing companies to process credit cards, debit cards, or other payment methods.
Payment transactions may be subject to the payment processor's terms and privacy practices.
CashPayClinics may not directly receive or store complete card information when payment credentials are collected directly by the payment processor.
CashPayClinics is not responsible for failures caused solely by third-party financial institutions or payment processors outside CashPayClinics' reasonable control.
18. REFUNDS
Refund eligibility depends on the circumstances surrounding the transaction and any applicable CashPayClinics or Provider refund policy.
CashPayClinics does not automatically guarantee refunds for services already provided by an independent Provider.
Disputes involving the quality, appropriateness, or outcome of medical treatment generally must be addressed directly with the Provider who provided the healthcare service.
CashPayClinics may assist with marketplace or payment-related issues but does not assume responsibility for resolving clinical disputes.
19. MEDICAL DECISIONS
Patients should discuss healthcare decisions directly with qualified healthcare professionals.
Information displayed on CashPayClinics concerning:
- Medical specialties;
- Procedures;
- Conditions;
- Treatments;
- Services;
- Pricing;
- Healthcare facilities; or
- Other health-related topics
is provided for informational or marketplace-navigation purposes and is not a substitute for individualized medical advice.
20. PRESCRIPTIONS AND MEDICATIONS
CashPayClinics itself does not prescribe medications.
Any prescription decision is made solely by an appropriately licensed healthcare Provider.
Finding or scheduling a Provider through CashPayClinics does not guarantee that:
- A medication will be prescribed;
- A medication will be refilled;
- A particular medication will be considered appropriate; or
- A Provider will agree with a patient's requested treatment.
21. LABORATORY, IMAGING, AND OTHER SERVICES
When laboratory tests, imaging studies, procedures, or other healthcare services are listed on CashPayClinics, the applicable Provider remains responsible for determining the conditions under which those services are provided.
Patients may need an order, referral, medical evaluation, or other authorization before receiving certain services.
CashPayClinics does not determine whether a particular service is medically appropriate for an individual patient.
22. PATIENT RESPONSIBILITIES
Patients agree to:
- Provide accurate information;
- Avoid impersonating another person;
- Use the Platform for lawful purposes;
- Treat Providers and Platform personnel respectfully;
- Attend confirmed appointments or cancel appropriately;
- Provide truthful information to healthcare Providers;
- Follow reasonable Provider procedures;
- Pay agreed charges for services received; and
- Seek emergency care when medically necessary.
Patients remain responsible for their healthcare decisions and for asking Providers questions about treatment, risks, alternatives, and costs.
23. PRIVACY
CashPayClinics' collection and handling of personal information is described in the CashPayClinics Privacy Policy.
By using the Platform, you acknowledge the Privacy Policy.
Healthcare Providers may maintain their own privacy policies and legal obligations concerning medical information.
Once information is transmitted to an independent healthcare Provider, the Provider may be responsible for that information under applicable healthcare privacy laws.
24. HEALTH INFORMATION
Information submitted through CashPayClinics may include health-related information.
Patients should provide only information reasonably necessary for the requested Platform service or Provider interaction.
CashPayClinics will handle information according to its Privacy Policy and applicable law.
Where HIPAA or another health privacy law applies to particular information or relationships, CashPayClinics and participating Providers will be subject to the responsibilities applicable to their respective roles.
25. MEDICAL RECORDS
CashPayClinics is not necessarily the custodian of the complete medical record for healthcare services provided by independent Providers.
Providers are generally responsible for maintaining medical records associated with the healthcare services they provide according to applicable law.
Patients seeking copies of medical records concerning treatment may need to contact the treating Provider directly.
CashPayClinics may retain Platform records such as appointment requests, transactions, account activity, and electronic communications according to applicable law and its Privacy Policy.
26. SMS AND ELECTRONIC COMMUNICATIONS
By providing a mobile telephone number and consenting where required, you may receive transactional messages concerning:
- Verification codes;
- Appointment requests;
- Appointment confirmations;
- Appointment reminders;
- Appointment changes;
- Security alerts;
- Account notifications; and
- Other operational communications.
Message frequency may vary.
Message and data rates may apply.
Where applicable, you may reply STOP to opt out and HELP for assistance.

Marketing messages, if offered, may require separate consent.
27. EMAIL COMMUNICATIONS
CashPayClinics may send operational emails concerning your account, appointment requests, security, payments, policies, or use of the Platform.
Marketing communications may contain an unsubscribe option where required by law.
Certain operational or legally required communications may still be sent while you maintain a CashPayClinics account.
28. PATIENT REVIEWS AND RATINGS
CashPayClinics may permit patients to review or rate Providers.
If you submit a review, you agree that your review will:
- Reflect your genuine experience;
- Not contain knowingly false information;
- Not impersonate another person;
- Not contain unlawful threats;
- Not contain malicious software;
- Not violate another person's intellectual-property rights; and
- Otherwise comply with Platform policies.
CashPayClinics may moderate, restrict, or remove reviews that violate applicable law or Platform policies.
CashPayClinics does not guarantee that all submitted reviews will be published.
29. USER CONTENT
If you upload, submit, or post information, reviews, photographs, messages, or other content to areas of CashPayClinics intended for such submissions, you represent that you have the right to provide that content.
You grant CashPayClinics a limited license to host, store, process, reproduce, and display that content as reasonably necessary to provide, operate, protect, and improve the Platform.
This does not give CashPayClinics ownership of your medical records or personal information.
Personal information remains subject to the CashPayClinics Privacy Policy and applicable law.
30. ACCEPTABLE USE
You may not use CashPayClinics to:
- Engage in unlawful activity;
- Commit fraud;
- Create false identities;
- Impersonate another person;
- Submit fraudulent appointment requests;
- Harass or threaten Providers or other users;
- Attempt unauthorized access to accounts;
- Circumvent Platform security;
- Introduce malware;
- Scrape or systematically extract Platform information without authorization;
- Harvest Provider or patient contact information;
- Interfere with Platform operation;
- Manipulate reviews or ratings;
- Use automated systems in violation of Platform rules; or
- Violate the rights of CashPayClinics or another person.
31. THIRD-PARTY SERVICES AND LINKS
CashPayClinics may contain links to or integrate with third-party websites and services.
These may include:
- Payment processors;
- Mapping services;
- Healthcare Provider websites;
- Communication services;
- Analytics services; and
- Other technology providers.
CashPayClinics does not control independent third-party websites.
Use of those services may be subject to separate terms and privacy policies.
32. INTELLECTUAL PROPERTY
The CashPayClinics Platform, including its software, name, logos, design, databases, graphics, text, and other proprietary materials, is owned by or licensed to CashPayClinics and is protected by applicable intellectual-property laws.
You are granted a limited, personal, non-exclusive, non-transferable, revocable right to use the Platform for lawful personal purposes consistent with these Terms.
You may not copy, sell, modify, reverse engineer, distribute, or commercially exploit CashPayClinics intellectual property except as permitted by law or expressly authorized by CashPayClinics.
33. PLATFORM AVAILABILITY
CashPayClinics attempts to maintain reliable Platform availability but does not guarantee uninterrupted access.
Temporary interruptions may result from:
- Maintenance;
- Software updates;
- Internet outages;
- Cybersecurity incidents;
- Telecommunications failures;
- Third-party service interruptions;
- Equipment failures; or
- Events outside CashPayClinics' reasonable control.
CashPayClinics may modify or discontinue Platform features as reasonably necessary.
34. NO GUARANTEE OF MEDICAL RESULTS
Healthcare outcomes vary among individuals.
CashPayClinics does not guarantee:
- Successful treatment;
- Diagnosis;
- Recovery;
- Symptom improvement;
- Prevention of complications;
- Satisfaction with a Provider; or
- Any particular healthcare outcome.
Medical outcomes are determined by numerous factors beyond CashPayClinics' control.
35. NO ENDORSEMENT
A Provider's inclusion on CashPayClinics does not mean that CashPayClinics guarantees or endorses every aspect of that Provider's services.
Patients should use their own judgment when selecting healthcare Providers.
Any Provider verification performed by CashPayClinics is intended to support marketplace integrity and should not replace a patient's own decision-making.
36. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASHPAYCLINICS IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
CASHPAYCLINICS DOES NOT WARRANT THAT:
- THE PLATFORM WILL ALWAYS BE AVAILABLE;
- EVERY PROVIDER LISTING WILL ALWAYS BE ERROR-FREE;
- EVERY APPOINTMENT REQUEST WILL BE ACCEPTED;
- EVERY DISPLAYED SERVICE WILL REMAIN AVAILABLE;
- EVERY DISPLAYED PRICE WILL APPLY TO EVERY MEDICAL SITUATION; OR
- USE OF THE PLATFORM WILL PRODUCE ANY PARTICULAR MEDICAL OR FINANCIAL RESULT.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be waived.
37. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASHPAYCLINICS AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO USE OF THE PLATFORM.
CashPayClinics is not responsible for the independent professional acts, omissions, negligence, malpractice, diagnosis, treatment, recommendations, billing practices, or other conduct of healthcare Providers.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
38. PATIENT-PROVIDER DISPUTES
Disputes concerning healthcare services, including:
- Medical treatment;
- Diagnosis;
- Professional negligence;
- Medical outcomes;
- Provider conduct;
- Medical records;
- Clinical decisions; or
- Provider-specific charges
are generally disputes between the patient and the independent Provider.
CashPayClinics may assist with Platform-related concerns but does not become responsible for the Provider's healthcare services merely because it assists with a complaint.
39. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless CashPayClinics and its affiliates, officers, employees, contractors, and agents from claims or losses arising from your unlawful misuse of the Platform, fraudulent activity, violation of these Terms, or infringement of another person's rights.
This provision does not require you to indemnify CashPayClinics for liability that applicable law prohibits CashPayClinics from transferring to you.
40. ACCOUNT SUSPENSION OR TERMINATION
CashPayClinics may restrict, suspend, or terminate an account when reasonably necessary, including in response to:
- Fraud;
- Abuse;
- Security threats;
- False information;
- Harassment;
- Illegal activity;
- Repeated misuse of appointment functionality;
- Violation of these Terms; or
- Conduct creating material safety, legal, or operational risk.
Termination does not eliminate obligations that accrued before termination.
41. ELECTRONIC ACCEPTANCE
You agree that these Terms may be accepted electronically.
Checking an acceptance box, clicking an acceptance button, creating an account, submitting registration, submitting an appointment request after being presented with these Terms, or otherwise electronically indicating agreement may constitute electronic acceptance to the extent permitted by applicable law.
CashPayClinics may maintain records documenting acceptance, including:
- User or account identifier;
- Name;
- Email address;
- Telephone number;
- Date and time;
- IP address where appropriate;
- Version of the Terms accepted;
- Acceptance status; and
- Related electronic audit records.
You consent to receiving agreements, disclosures, notices, and other records electronically where permitted by law.
42. CHANGES TO THESE TERMS
CashPayClinics may update these Terms from time to time.
The current version will display its effective date.
Material changes may be communicated through:
- The Platform;
- Email;
- Account notification; or
- Another reasonable method.
Where appropriate or required by law, CashPayClinics may require users to affirmatively accept updated Terms before continuing to use certain Platform features.
43. GOVERNING LAW
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable federal law controls.
44. INFORMAL DISPUTE RESOLUTION
Before initiating formal arbitration concerning a dispute directly between you and CashPayClinics, you and CashPayClinics agree to make a reasonable good-faith effort to resolve the dispute informally.
You may initiate informal resolution by contacting:
The notice should reasonably identify the account and describe the nature of the dispute and requested resolution.
This section applies to disputes with CashPayClinics and does not require CashPayClinics to resolve independent medical malpractice or professional disputes between patients and Providers.
45. BINDING ARBITRATION
To the extent permitted by applicable law, disputes arising directly from or relating to these Terms or your use of CashPayClinics that cannot be resolved informally shall be resolved through binding arbitration rather than a jury trial, except where applicable law provides otherwise.
Unless otherwise required by law or agreed by the parties, arbitration shall take place in Bexar County, Texas.
Eligible claims may still be brought in small claims court.
Either party may seek temporary or injunctive relief from a court of competent jurisdiction when necessary to protect intellectual property, account security, confidential information, or other rights requiring immediate equitable relief.
The arbitration agreement shall be interpreted and enforced in accordance with applicable federal and state law.
46. INDIVIDUAL DISPUTE RESOLUTION
To the extent permitted by applicable law, arbitration between a user and CashPayClinics will be conducted on an individual basis rather than as a class, consolidated, or representative proceeding.
Nothing in these Terms waives any right that cannot legally be waived.
47. SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining Terms will remain in effect.
48. NO WAIVER
CashPayClinics' failure to enforce a provision of these Terms does not waive its right to enforce that provision later.
49. ENTIRE AGREEMENT
These Terms, together with the CashPayClinics Privacy Policy, SMS/Text Messaging Terms, Cookie Policy, applicable payment or refund terms, and any other policies expressly incorporated by reference, constitute the agreement governing your use of CashPayClinics.
